A federal court in California took just hours on Monday to throw out Elon Musk’s claims against Sam Altman and OpenAI.he tricked her into fundinga company with commitments to run it as a non-profit organization for public welfare.
Musk accused the maker of ChatGPT and its leaders, including CEO Altman and president Greg Brockman, of “stealing charity” by launching a massive commercial venture that has become one of the most well-known and highly valued artificial intelligence businesses.
The judges ruled that Musk’s claims alleging unjust enrichment, breach of charitable trust and related claims against Microsoft for aiding and abetting the infringement were untimely and barred by the statute of limitations. U.S. District Judge Yvonne Gonzalez Rogers — who was presiding over a parallel hearing Monday on potential settlements when the sentence was handed down — announced immediately that she would accept a non-binding advisory ruling.
The settlement phase of the case – in which Rogers expressed serious doubts about the first witness who testified on Musk’s behalf – is now over.
The case against OpenAI wasconsidered to existthreatening the basic structure of the giant artificial intelligence and its ability to survive in its current state. Musk asked for a settlement including more than $100 billion in damages, the removal of Altman and Brockman from executive and board roles, and restructuring to return OpenAI to its original non-profit status.
OpenAI is reportedly preparing for amost likely initial public offeringswhich could approach $1 trillion in value.
Musk is expected to appeal the decision.
